1. Acceptance of Terms
By accessing or using Fluxventory ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not use the Service. These terms apply to all users, including visitors, registered users, and subscribers.
2. Description of Service
Fluxventory is a cloud-based inventory management platform providing real-time stock tracking, barcode scanning, AI-powered insights, and multi-tenant data management. The Service is accessible via web browser (PWA) and mobile applications.
3. User Accounts
You must provide accurate and complete registration information. You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized use of your account. One person or legal entity may not maintain more than one free account.
4. Subscriptions and Payments
Paid plans are billed monthly or annually in advance. Prices are listed in EUR and do not include applicable taxes. You may upgrade, downgrade, or cancel your subscription at any time. Downgrades take effect at the end of the current billing period. Refunds are not provided for partial billing periods. We reserve the right to modify pricing with 30 days advance notice.
5. Acceptable Use
You agree not to: - Use the Service for any illegal purpose or in violation of any laws - Attempt to gain unauthorized access to the Service or its related systems - Interfere with or disrupt the integrity or performance of the Service - Upload or transmit viruses, malware, or other harmful code - Use the Service to store or transmit infringing, defamatory, or otherwise unlawful content - Exceed reasonable usage limits or use the Service in a way that degrades performance for other users
6. Data Ownership and Portability
You retain full ownership of all data you upload to the Service. We do not claim any intellectual property rights over your content. You may export your data at any time using the built-in export tools. Upon account termination, your data will be retained for 30 days before permanent deletion, during which time you may request an export.
7. Intellectual Property
The Service, including its original content, features, functionality, and design, is owned by Fluxventory and protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without prior written consent.
8. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
9. Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding reliability, accuracy, or availability. In no event shall Fluxventory be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or in-app notification at least 30 days before changes take effect. Continued use of the Service after changes constitutes acceptance of the modified Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
